Estate Planning
Every individual, whether they are aware or not, already has an estate plan as dictated by the New York State rules of intestate distribution. Moliterno P.C. provides the counsel necessary for individuals to take control of their assets and to formulate a plan by which their possessions are to be distributed. The Firm's practice ranges from the drafting of simple wills to the implementation of more complicated tools such as trusts, gifting programs, family limited partnerships and the like.
Probate and Estate Administration
No amount of planning can suitably prepare an individual for the difficult and unexpected challenges that are presented when a loved one passes. Douglas Moliterno is an empathetic and knowledgeable attorney who is experienced in all areas of probate and administration. He is familiar with the technical workings of the probate and administration processes and provides the guidance necessary for an Executor to properly administer an estate. In particular, the Firm will help you through the following steps as well as the unique challenges that each administration presents:
- Petitioning the Surrogate's Court for the probate of a will and to appoint the Executor of an estate, and, in the case of a decedent who leaves no will, petitioning the Surrogate's Court for the appointment of an Administrator;
- Marshaling and preserving all estate assets, and maintaining accurate records throughout the estate administration;
- Estimating the cash requirements of the estate and liquidating assets to meet such requirements;
- Satisfying decedent's debts;
- Preparing and filing with the Surrogate's Court an inventory of decedent's assets;
- Preparing and filing any necessary tax returns and proceedings;
- Preparing and settling the Executor's or Administrator's account of proceedings; and,
- Distributing estate assets pursuant to the terms of the Will or the laws of intestacy, as required.
